What dictates the open window behavior?

When I have a TextPad window already open it appears to be totally random when I double-click on a supported filetype if the file opens in the existing TextPad window or if the file opens in a totally new TextPad window. The only consistency appears go be that my files always tend to open with the opposite behavior of what I want.

Any ideas?

What's your setting for Allow multipe instances to run (Configure > Preferences > General)
